I'm unhappy with the decision

This could occur under two scenarios. Firstly, you are the applicant and you didn’t get all you wanted, or secondly, you are a third party and the agency has decided to release your information over your objections.

THE APPLICANT
The applicant can either lodge an Internal Review (a further review by the agency). This may be of value if you think there are issues that should have been, but were not considered, or if you want to put additional information to the agency before proceeding to an external appeal.

You can chose to lodge an Internal Review within 20 working days of the original decisions. Depending on the agency you may also have to pay a fee of $40, unless the fee is waived or you are entitled to a fee reduction.

If you do not like the Internal Review decision you can go to external appeal. Alternatively, you can proceed straight to an external appeal, without going to an Internal Review, to either the Information Commissioner or the NSW Civil and Administrative Tribunal.

The appeal has to be lodged within 40 working days of the agency decision. You can get more information on our links resources page.

THE THIRD PARTY
If you want to appeal to the Information Commissioner, you must go through the Internal Appeal process first.

You have to lodge an Internal Review within 20 working days of the original determination (decision). Depending on the agency you may also have to pay a fee of $40.

If you do not like the Internal Review decision you can go to external appeal. Alternatively, you can proceed straight to an external appeal, without going to an Internal Review, to the NSW Civil and Administrative Tribunal.
The appeals have to be lodged within 40 working days of the agency decision. You can get more information on our links resources page.
